In 2005, the Supreme Court published a decision in a case called National Cable & Telecommunications Ass’n v. Brand X Internet Service, 545 U.S.967. The immigration agencies have used the decision in the Brand X case in a manner that is expansive and contrary to the interests of the immigrant communities. On behalf of the American Immigration Lawyers Association, the attorneys at ILG filed an important amicus brief that outlines the basic principles of administrative law and demonstrates that the courts should be more protective of immigrant rights. Federal Court Narrows Deference Standard for Agency Decisions

For many years, it was unclear what type of deference a federal court should give to the thousands and thousands of unpublished decisions issued by the Board of Immigration Appeals. This was especially important because the Board generally issued unpublished and poorly reasoned decisions. In an en banc opinion, the United States Court of Appeals for the Ninth Circuit agreed with the ILG legal team, who wrote a brief on behalf of the American Immigration Lawyers Association, and limited deferential review only to published decisions.
